BUSINESS CLOUD - SERVICE DELIVERY POLICIES & TERMS OF USE

To keep the quality and reputation of Business Cloud’s Services at a high level, we set out the policy for providing the Services to you. Your use of the Services is also subject to the program policies listed below. The rights and obligations arising from the policies below do not negate but rather apply in parallel with the Terms of Service. Please read them carefully.
These Terms of Use (“Terms”) are a binding legal agreement between you (“User,” “Customer,” “you,” or “your”) and Business Cloud Co (“Business Cloud,” “Company,” “we,” or “us”), governing your access to and use of our business applications, platforms, and related services (collectively, the “Services”), which include, among other things, apps made available through application platforms.
Service Use Policy
By downloading, installing, or using the Services, you declare that you have read, understood, and accepted these Terms. If you do not agree, you must immediately discontinue use.
By accessing or using any Business Cloud Service, you confirm that:
• You are at least 18 years old or have reached the legal age of majority in your jurisdiction.
• You are authorized to accept the Terms on your own behalf or on behalf of the entity you represent.
• You will comply with all applicable laws, regulations, and the terms of the App Stores.
Amendments to the Terms
Business Cloud may periodically revise the Terms. Updates will be communicated via in-app notifications, email, or on our website. Material changes will take effect at least 10 days after notice, unless required immediately by law or for security reasons. Continued use constitutes acceptance.
License Grant
Subject to the Terms, Business Cloud grants you a limited, non-exclusive, revocable, and non-transferable license to install and use the Services solely for personal or business purposes.
You are prohibited from:
• Copying, modifying, or distributing the Services.
• Decompressing, disassembling, or reverse-engineering the source code, unless expressly permitted by law.
• Leasing, sublicensing, or reselling the Services without written permission.
Account Registration & Security
An account is required to access certain features. You agree to:
• Provide accurate and up-to-date information.
• Keep your login credentials confidential.
• Notify Business Cloud immediately of any unauthorized use.
Business Cloud is not responsible for losses resulting from account breaches due to negligence.
Acceptable Use
Misuse of the Services is prohibited. Indicatively:
• Attempting unauthorized access.
• Transmitting viruses, malicious code, or similar items.
• Interfering with normal operation.
• Using the Services in violation of laws or third-party rights.
Violations may result in suspension or permanent termination of access.
Intellectual Property Rights
All intellectual property rights in the Services (software, design, trademarks) belong exclusively to Business Cloud.
Use does not imply transfer of ownership.
User Content
You retain ownership of the content you upload (“User Content”).
You grant Business Cloud a worldwide, free, non-exclusive license to host, process, and use it solely for providing and improving the Services.
Privacy & GDPR Compliance
Business Cloud respects your privacy.
• We comply with the General Data Protection Regulation (GDPR) and related laws.
• We collect and process only the personal data necessary.
• You have the right of access, rectification, erasure, and restriction of processing.

Cookies & Tracking Technologies
Our apps and websites use cookies and similar technologies to:
• Improve functionality and experience.
• Analyze usage.
• Provide personalized content and advertising.
By using the Services, you consent to the use of cookies in accordance with our Cookie Policy. You can adjust settings in your browser or device.
Service Level Agreement (SLA) – Availability
Business Cloud guarantees 99% monthly availability, meaning the Services will be available at least 99% of the time in each calendar month.
The following do not count as downtime:
• Scheduled maintenance (with prior notice).
• Issues on third-party networks or force majeure.
• Use in violation of guidelines.
If the commitment is not met, any claims must be submitted in writing within 10 days from the end of the month.
Subscriptions
Business Cloud provides its Services on a subscription basis and reserves the right to change the timing and amount of subscriptions without prior notice. It may also modify the technical characteristics, the name, and the number of services included in subscriptions at any time.
The duration of the user’s current subscription is not affected, and no capabilities or features of the existing active and fully paid subscription are removed.
In the event of late payment, it reserves the right to stop access to its Services, downgrade the Account to another plan, or even remove it entirely.
Upon expiration, subscriptions limit or completely remove the user’s access to Business Cloud’s Services. In the event of renewal, the subscription date continues from the last expiration date of the subscription.
Data Retention & Deletion
After account termination, data is retained for at least 90 days so that recovery may be requested. Thereafter, the company may proceed to permanently delete any data that is not required to be kept by law.
Disclaimer of Warranties
The Services are provided “as is” and “as available.”
Business Cloud disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law:
• Business Cloud is not liable for indirect, incidental, or consequential damages, such as loss of profits or data.
• Total liability is limited to the amount you paid in the 12 months prior to the incident.
Indemnification
You agree to indemnify and hold harmless Business Cloud, its officers, and its partners from any claim, damage, or expense arising from:
• Breach of the Terms.
• Misuse of the Services.
• Violation of laws or third-party rights.
Suspension & Termination
Business Cloud may suspend or terminate access if:
• You breach the Terms.
• Required by law.
• Deemed necessary to prevent risks or technical issues.
The user may discontinue use at any time. Certain obligations (e.g., payments, indemnities) remain in force.
Governing Law & Jurisdiction
The Terms are governed by the law of Greece.
The courts of Athens have exclusive jurisdiction over any dispute.
Miscellaneous
• Entire Agreement: The Terms together with the Privacy Policy, Cookie Policy, and SLA constitute the entire agreement.
• Severability: If any provision is found invalid, the remaining provisions remain in force.
• Assignment: You may not assign the Terms without consent. Business Cloud may assign them freely.
PRIVACY POLICY
Business Cloud Co (“we,” “us,” or “Company”) is committed to protecting the privacy and personal data of our users (“you,” “User,” “Customer”). This Privacy Policy explains how we collect, process, store, and protect your data in accordance with the General Data Protection Regulation (GDPR) and applicable Greek legislation.
Information We Collect
• Account Details: Name, email, contact information, password, business details.
• Payments: Transaction data via secure payment providers (we do not store card numbers).
• Technical Data: IP address, device type, operating system, cookies, and usage logs.
• User Content: Files, messages, or data you upload to the Services.
Purpose of Processing
We use your data to:
• Provide and improve the Services.
• Offer customer support and communication.
• Invoicing, payments, and compliance with tax obligations.
• Ensure security and prevent fraud.
• Perform statistical analysis of usage.
Legal Basis for Processing
Processing is based on:
• Performance of the contract (provision of Services).
• Compliance with legal obligations.
• Our legitimate interests (improvement, security).
• Your consent (e.g., for promotional emails).

Business Cloud has the right to use any communication channel it wishes with the user (indicatively phone, email, SMS, postal mail) to inform them about any matter it deems appropriate. The user expressly gives their consent for this and undertakes the obligation to regularly check both the validity of their contact details and their access to them.
